Economou & Co LLC has published a new guide on trademark infringement in Cyprus, the first in a three-part series on trademark and passing off disputes, examining the statutory protection available to registered trademark owners under the Trademarks Law, Cap. 268.

The guide sets out what can be registered as a trademark, how rights are acquired and interact with EU trademark protection, and the three heads under which infringement is established: use of an identical sign for identical goods, likelihood of confusion, and unfair advantage taken of a mark with a reputation.

The guide also covers the defences available to a defendant, including contesting validity, acquiescence, honest practices and exhaustion, and the remedies open to a successful claimant, including a final injunction, damages or an account of profits, and delivery up.
