Economou & Co LLC has published the third guide in its series on the protection of intellectual property rights in Cyprus, examining how the courts grant interim relief in trademark and passing off disputes pending trial.

For a business whose trademark or goodwill is being exploited by a competitor, what happens in the months, sometimes years, before judgment is delivered often matters more than the judgment itself. The guide sets out the three cumulative conditions a claimant must satisfy under section 32 of the Courts of Justice Law, Law 14/60, to obtain an interim injunction – a serious issue to be tried, visible prospects of success, and irreparable harm – and explains why the last of these often carries particular weight in trademark and passing off cases, since damage to goodwill and reputation is not easily reduced to a figure.
